This movie documents not only the infamous "McDonald's Hot Coffee" case, but is a real eye-opener concerning our civil justice system and will leave you with a feeling that you've learned something new about something you thought you already knew about. Ever hear the terms, "jackpot justice," "frivolous lawsuit" or "lawsuit abuse?" Are you familiar with politically-heavy, corporate funded, multi-media propaganda that is eroding your rights by changing your perception of the truth, or "astroturfing?" What about your Seventh Amendment right to a civil trial by jury? What about tort reform?
Remember back in elementary school, talking about the three branches of government? What was probably not explained to you was how you, the individual bringing a lawsuit, exercising your right to a jury trial, or sitting on a jury - you the individual have more control over the laws than you may believe. When you decide to litigate a matter, or when you decide a matter as a juror, you help to put certain matters "at issue" or bring it to the Court's attention for decision - a matter cannot be decided - and the laws made or changed - until it is ripe. This is America, folks, and rather than the old-school "eye-for-an-eye" or "pound of flesh" justice, you have a Constitutional Right to have compensation for your harms and a remedy for your damages through our civil justice system. Is this just "trial lawyer propaganda?" Probably. But I'm not gonna tell you that. Watch the film, and make up your own mind. All I can tell you is yes, I am a trial lawyer, and perhaps today's post is colored from that perspective. But trust me, I'm not in it for the money (I do so much pro bono and amicus work and eat so much Ramen noodle it ain't even funny). I became a trial lawyer because I needed to do something about the erosion of our human rights and civil liberties.
